SEC Says Bitcoin And Ethereum Are Not Securities?

SEC Says Bitcoin And Ethereum Are Not Securities

It was a bloody week for the markets, but at least there’s a bit of good news: an official for the Securities and Exchange Commission has publicly stated that Ether and Bitcoin should not be regulated as securities. The announcement puts to rest months of speculation about a possible ban hammer on the two largest cryptocurrencies.

Speaking at Yahoo Finance’s All Market Summit: Crypto, William Hinman, the Director of Corporate Finance for the SEC, said:

When I look at Bitcoin today, I don’t see a central third party whose efforts are key factor to determining the success of that enterprise. The network on which bitcoin functions is operational and appears to have been decentralized for some time….Moreover, putting aside the fundraising that accompanied the creation of Ether, based on my understanding of the present state of Ether, the Ethereum network, its decentralized structure, we believe that current offers and sales of Ether are not securities transactions….”

In the United States, investment contracts are adjudicated by the “Howey Test.” Invesments whose profits depend on the actions of a third party–like stock offerings–are regarded as securities, and are subject to disclosure laws.

These requirements exist for the investors’ protection, Hinman said. “The promoter is liable for misstatements. That’s an important safeguard, and that’s appropriate for many of the ICOs we see.”

However, the distinction gets blurry in the case of decentralized networks, Hinman explained. “If the network on which a token or coin is to function is no longer centralized, and the purchasers no longer have a reasonable expectation that a person or group is going to carry out a central managerial or enterprise effort, those assets might not represent an investment contract.”

Bitcoin, which was not issued in an ICO, was already regarded as a commodity rather than a security, although the statement helps to clarify the situation.

But Ethereum is complicated because of the circumstances of its ICO. Although the token currently has utility, there was some concern that its speculative nature might have caused the SEC to consider it a security. And to muddy the waters further, there was no “single” third party promoter: Ethereum was a community effort, in a way that most contemporary ICOs are not.

His words put an end to months of speculation, in which markets hinged on fears of a regulatory crackdown. The CFTC has repeatedly asked the SEC for clarification on the status of Ether.

While markets are celebrating the news, it may be too early to pop the champagne, especially if you’ve got large investments in ERC-20s. Hinman’s speech emphasized that most initial coin offerings are securities, and this stance is consistent with the signals from top SEC leadership. “Much of what I have seen in the ICO or token or ICO space, is a security offering” said SEC Chairman Jay Clayton in Atlanta yesterday. “I don’t know how much more clear I can be about it.”

Ripple, which was also distributed in a largely-centralized ICO, remains in limbo. The company behind the third-largest crypto has been accused in several class-action lawsuits of selling the XRP token as an unregistered security.

The markets saw an immediate rally, with ETH seeing a 9.29% gain and BTC rallying 4.75% at the time of writing.

2 Big Investment Themes For 2018 ?

2 Big Investment Themes For 2018

After investors sat out the nearly nine-year bull market, some investors are finally getting back in.

Discount brokerages TD Ameritrade Holdings Corp., E*Trade Financial Corp. ETFC 0.69% and Charles Schwab Corp. reported surges in client activity at the end of 2017 that have accelerated in January. The firms attributed much of the activity to retail, or individual, investors who are opening brokerage accounts for the first time, some of them lured by the boom in cryptocurrency and cannabis investments.

We share our secret CANNABIS coins & IDEAS & other great coins in our VIP membership, see below

Investors are getting into the psychology and fear of missing out, especially withyounger investors as the stock market keeps hitting new highs.

This rise in interest in some of the riskiest new areas highlights investor optimism that is spurring more trading activity across age demographics and markets. And analysts say the strong trading activity from Ameritrade , results reminiscent of their heady days during the tech-stock boom—suggests people should know the risks.

After retreating from the market in recent years, investors have piled into stocks in recent weeks. They put $33.2 billion into global stock mutual funds and exchange-traded funds in the week through Wednesday, the biggest inflows for any comparable stretch going back to 2002, according to Bank of America Merrill Lynch. Further demonstrating an increasing euphoria, investors have put almost $258 million combined into 10-day-old ETFs that buy companies that have invested in blockchain, the technology behind cryptocurrencies.

We share our secret IDEAS & other great CRYPTO coins in our VIP membership, see below.

some of the younger clients who are trading, have huge interest in the highly speculative areas of cryptocurrencies, including bitcoin, and cannabis.

people want to get in on the bull market action before it ends and is more versed and interested in cryptocurrencies and “pot” investments than older investors.

But the craze hasn’t been limited to millennials. “I’m seeing thousands of percentage points of returns,” said William Starr, 58, an information-technology manager in Roseburg, Ore., of his investments in cryptocurrencies.

Over the past year or so, the three main U.S. stock indexes have surged to record after record. The Dow Jones Industrial Average, for instance, in 2017 alone ran from 20000 to 26000, setting records for speed in hitting 1,000-point increments. Stock gains, however, pale in comparison to gains in cryptocurrencies such as bitcoin, which was up around 1,400% last year.

“Crypto and cannabis…volumes have been up huge,” E*Trade Chief Executive Karl Roessner said Friday on the firm’s fourth-quarter earnings call with analysts and investors. Despite the bitcoin-futures offering not being “a material offering,” Mr. Roessner said about a 10th of daily average revenue trades—a key metric for brokerages—has so far this month been blockchain- or pot-related.

As a sign of the growing interest of younger investors in crypto and cannabis, the no-commission investment app Robinhood said it would begin letting customers directly buy and sell bitcoin and Ethereum without any added transaction fees starting in February.  Coinbase’s fees of 1.5% to 4% in the U.S. Late last year, which investors are growing to hate.

Even bigger funds are dipping into crypto and cannabis as new opportunities that are attracting clients.

The spreading euphoria could mark a new phase of a long a rally that many investors are just getting in on. Engagement levels are high even excluding those areas, strong interest in speculative cryptocurrency and cannabis markets.

The question for many analysts and investors now becomes whether surging retail trading and interest in nascent, highly speculative markets are signs that the market is overvalued. SENTIMENT TRADER is unsure about whether these are the “earlier days of a new cycle as economic growth picks up, or “the later days of a nine-year bull market.” Time will surely tell.

Bitcoin exchange Coinbase launches the Dow Jones of cryptocurrencies

"Bitcoin exchange Coinbase launches the Dow Jones of cryptocurrencies"

what the Bitcoin exchange Coinbase launches the Dow Jones of cryptocurrencies ? What this all about..... See below.

------------------------------

Sentiment Trader told   ==> our VIP MEMBERS here <==  that Popular online exchange Coinbase is releasing a weighted index fund for cryptocurrencies.

"It's a very simple to use, easy way to get exposure to the crypto-assets that we offer on our exchange," Coinbase President and COO Asiff Hirji told CNBC's "Fast Money" Tuesday.

This could be one to watch -- See the chart below....

Our Members here => VIP members here    The Coinbase Index Fund will give accredited U.S. investors exposure to all assets listed on the company's current exchange, GDAX. The currencies will be weighted based on market capitalization.

Much like how the Dow Jones Industrial Average is a basket of 30 stocks meant to give a sense of the American economy, this fund will try to reflect major trends in the cryptocurrency market.

Coinbase is the leading U.S. marketplace for buying major cryptocurrencies. Its GDAX exchange for professional traders offers bitcoin, bitcoin cash, litecoin and ethereum . It does not currently offer ripple, or XRP.

The company has been cautious when adding new currencies to the exchange, and is working to avoid any "rubbish out there", Hirji said. But whenever a new coin is listed, Coinbase told CNBC it will automatically be added to the fund.

"There has been a lot of discomfort from the SEC around a lot of these ICO-based tokens," Hirji said. "We're not going to be the ones operating in the black."

Only U.S. residents are legally allowed to invest at this stage, Hirji said, citing SEC oversight as a key reason.

Grayscale bitcoin also launched new crypto investing products Tuesday. The company added four new funds that each hold positions in a single cryptocurrency.

Like Coinbase's product, Grayscale's new trusts will be offered to accredited investors with a minimum $10,000 investment. But unlike Coinbase, Grayscale has a one-year vesting period.

Hirji pointed to Coinbases's broader approach, which he said is more tailored to individual investors.

"I think the investors are not going to want to pick specific winners or losers," Hirji said.

what the  Secret way to make money with bitcoin - Secret way to make money with bitcoin? What this all about..... See below.

Sentiment Trader told   ==> our VIP MEMBERS here <==  that there is a Secret way to make money with bitcoin.

this is not written on other blogs, and what we are sharing today is something special, yes! A way to profit from bitcoin, using different exchanges.

There is a bunch of different prices between the market, and the exchanges right now. There are not many people that know about this, and you can actually take advantage of such opportunities and make a lot of money.

how do you do this? its a great question.

Unlike the traditional equities market you have almost hundreds of different exchanges, all with their different prices and trading levels. What some people are doing is grabbing hold of specialized software technology, that connects all the different exchanges, and looks for the price differences and buys low in one, and sells high on the other. SO no matter what the prices are doing with bitcoin itself you are almost always guaretneed to make profits.

when people first get involved with bitcoin, they see 20% - 30% differences in price. Their mind usually boggles because there is no where else in the world this exists.

right now arbitrage trading is fairly new, but the best 3 or the most commonly coins used to to this, is currently BITCOIN, ETHEREUM and RIPPLE.

The sky is the limit' for blockchain technology ?

Blockchain technology can reduce the time to settle a leveraged buyout from 20 to 30 days to a matter of minutes, and SENTIMENT TRADER are finding some seriously good investments in this world, and our members can see how this TREND on wall st is just starting.

Disney likened bitcoin to email: Bitcoin is the first "killer" blockchain technology app, just like email was the first "killer" internet app.

Wall Street may not be crazy about bitcoin, but it is intrigued by its use of blockchain technology. That is the point we wont to get across today.

Today, private equity transactions that use leveraged buyouts financed with debt can take 20 to 30 days to close and settle, global head of software investment banking. With blockchain technology, that could take only a matter of minutes.

If you add up all of our volume over the quarter, that's hundreds of billions of dollars we're able to free up and take out of the system to use for other purposes.

Credit Suisse has run experiments using blockchain technology in other parts of the business!

I think the sky's the limit, really, We're in the very, very early stages here, so its very exciting.....

will bitcoin rise to $5000 - will bitcoin rise to $5000

will bitcoin rise to $5000

"will bitcoin rise to $5000"

in the news - will bitcoin rise to $5000? What this all about..... See below.

------------------------------

There is much hype surrounding bitcoin right now, and many people who claim to by psychic think the price will soon reach $5000 per coin. But is this all crazy hype bubble-mania or is this coin the real deal and about to skyrocket into the atmosphere and create more millionaires along the way.

IT is obvious that the genie is out of the bottle, and cryptocurrencies will continue to rise and take market share away from stocks, other precious metals, bonds and currencies  investors should take a shot on this If you lose a few bucks, at least you took a shot  In life, you miss every shot that you do not take. It will probably be more upsetting to watch it (from the sidelines) go up another  500%."

Another rival digital currency ethereum could double in value from just under $200 to reach $400 in the next year, and another digital currency, litecoin, to double from about $40 to $80.

stock analyst say  the top 20 digital currencies by market are creating huge buzz and it might be time to look at the crypto world if people have money to burn.
In 10-15 years from now, the charts on a few of the top 20 names could look like the Amazon, Apple, Tesla, Facebook, Netflix and Google charts look today.
Bitcoin has already as developers go ahead with a scheduled upgrade known as Bitcoin Cash. Direct owners of bitcoin will then hold two versions of the digital currency.

The market is telling you right now that there are many positives going forward and bitcoin due to limited supply in 2020 could make bitcoin even more rarer than gold.

The digital currency hit a record $4,025 in this week with wall st analysts now circulated and wondering what all the hype is about.
If major trends develop,  bitcoin could reach $5,000 "in a few years, we are not far away right now.

Since march 2017, institutional attention on bitcoin has only increased.
Fundstrat co-founder Tom Lee became the first major Wall Street strategist to publish a report about bitcoin on July 7. Less than a week later, Switzerland's financial market regulator authorized the first Swiss bank to manage bitcoinfor clients, while the U.S. Commodity Futures Trading Commission last Monday approved the first bitcoin options platform. This is big news, and caused some of the biggest names on wall st to look at this asset.

Last Tuesday, the U.S. Securities and Exchange Commission also issued a report and investors bulletin on initial coin offerings, or sales of new digital coins.
There is now little doubt that 1% of the money in cash, bonds, stocks and gold will end up in cryptocurrencies, and that would only put the icing on the cake for bitcoin.

Since the $80 billion cryptocurrency market right now is a 25th of 1 percent of the $200 trillion in gold, cash, stocks and bonds, we must  point out digital currencies will need to increase by 25 times in order to reach 1 percent of the overall capital market.

If cryptocurrencies become part of asset allocation models and take 2 to 4 percent of capital markets, then the digital currencies will likely increase 100 times in value. That is very possible in the coming years.

Of course there are a host of risks for investing in digital currencies, including inherent high volatility, large-scale hacks on cryptocurrency firms and potential regulation, especially in China, that could cause prices to "collapse." That could be fast, but it’s a risk some market players are willing to take.

In addition, there does seem to be a lack of customer support for online digital currency products.

"There is no telephone support," he said in the report. "You must go to the FAQs section and spend a long time looking for the answer to whatever question you may have — and then you may not be happy with the answer. Your only other option is to send an email to customer support which could take anywhere from one-to-seven days to get a reply."

All that said, it might be the right time to buy digital currencies is now. He described in his report how investors can buy bitcoin, and why financial institutions are interested in the blockchain technology behind bitcoin and other digital currencies. The potential of this might be even bigger than bitcoin itself.
Some people keep watching from the sidelines for a few years and it felt recently as if the train is leaving the station, if we are talking NFL football,  we are still in the first quarter of a four quarter game and that even though I missed out on significant gains (2014 - 2016), it might not be too late to get in.

A new digital currency is about to be created as the bitcoin blockchain is forced to split in two

A new digital currency is about to be created as the bitcoin blockchain is forced to split in two

"A new digital currency is about to be created as the bitcoin blockchain is forced to split in two"

in the news A new digital currency is about to be created as the bitcoin blockchain is forced to split in two? What this all about..... See below.

------------------------------

Sentiment Trader has seen a keen interest in bitcoin lately.

Bitcoin faces a pivotal moment as investors are about to receive an entirely new asset called Bitcoin Cash after the blockchain supporting the cryptocurrency is forced to split in two.

The creation of Bitcoin Cash is certainly a pivotal moment for Bitcoin and its community.

"The inception of Bitcoin Cash may prove to be exactly what Bitcoin needs."

On August 1, a "user activated hard fork" will take place. Members of the bitcoin community unhappy with the direction of the digital asset have set up an alternative "node" called Bitcoin ABC.

Upon hearing the news, the price of bitcoin did JUMP and we are about to BUST OUT TO ALL TIME HIGHS! WOW!

Nodes are required to send messages across the bitcoin network, but Bitcoin ABC will use a different set of rules, causing the blockchain (the digital ledger which records every bitcoin transaction) to fork and create two separate digital assets: the original bitcoin and Bitcoin Cash.

And because Bitcoin Cash will have all the history from the old blockchain, any investors with bitcoin tokens will receive the same number of tokens on the new blockchain.

However, Bitcoin Cash will likely only be worth a fraction of bitcoin. The original digital currency is trading around $2778.39 today, but future values for Bitcoin Cash on the website Coin Market Cap are just $288.35, or 0.103 of a bitcoin.

Why is bitcoin splitting?

The bitcoin community has been divided on how to solve its scaling issue. Currently, only 1 megabyte of transactions can be processed at any one time, leading to delays.

"Demand for Bitcoin has been so high in recent months, that those creating the cryptocurrency can't keep up, slowing transactions," Iqbal Gandham, U.K. Managing Director at eToro, said in a press statement on Monday.

"For bitcoin to continue to scale and have the potential to become a globally used currency, this slowdown in transactions has to be addressed."

Haobtc's bitcoin mine site manager, Guo-hua, checks mining equipment inside their bitcoin mine near Kongyuxiang, Sichuan, China.

Bitcoin miners attempted to solve the scaling debate earlier this month by signalling support for SegWit2X. This would introduce "segregated witness" to the block chains, which would move some of the data outside the main bitcoin network to increase its capacity, and later increased the number of transaction to 2 megabytes.

However, some investors, miners and exchanges are unhappy with the proposal and think that it doesn't go far enough. Bitcoin Cash will increase the transaction limit to 8 megabytes.

"This means that the two sides that were once debating within Bitcoin, can instead apply their different views of what the cryptocurrency should be in two different blockchains," said Hayter.

"So while this is a development that sparked from previous disagreements, it may come to end the scaling debate once and for all."

Who is supporting Bitcoin Cash?

Bitcoin exchanges are divided on whether or not to support Bitcoin Cash. Several exchanges, such as BitMEX, Bitstamp and Coinbase, have said they will not support or allow trading of Bitcoin Cash on their exchanges, which means investors holding bitcoins on these sites will not receive any new tokens.

Some exchanges are also suspending bitcoin trading, withdrawal and deposits around the time of the fork. Hayter advises bitcoin investors to check for any statements issued by their exchange to find out whether or not they will receive the new token.

People attend a Bitcoin conference in New York. (File photo).
Bitcoin Cash may gain more support once it launches, according to Garrick Hileman, research fellow at the Cambridge Centre for Alternative Finance.

"Because millions of bitcoin users will automatically own Bitcoin Cash, and because a sizable number of wallets and exchanges (including some of the largest) have announced support for Bitcoin Cash, it is likely to live on for the foreseeable future," he told CNBC via email.

"Bitcoin Cash could be significant but we won't know more until after it launches. If it fails to sustain support then it could fade away."

What will Bitcoin Cash be worth?

Aurélien Menant, founder and CEO of Gatecoin, a regulated bitcoin and ethereum token exchange based in Hong Kong, says parts of the community are referring to the new token as Bcash. He says the new coin will pose no threat to the future of bitcoin.

"Investors holding both bitcoin and Bcash may benefit from the speculative price gains in both cryptocurrencies following the hard fork, but adoption of Bcash as a network will be limited in the short term."

Fran Strajnar, co-founder & CEO of data and research company Brave New Coin, says most cryto currency funds and investors are looking forward to receiving their free tokens.

Most will likely hold as it's free, just to see what happens or for hedging.

However a majority of everyday users, traders and investors are vocal about market dumping their free tokens as soon as they can.

If there's any legs at all to Bitcoin Cash or if the miners backing it deploy large scale and sustained attacks on bitcoin, then Bitcoin Cash may survive its initial violent birth.

Whatever happens, bitcoin will not disappoint in terms of creating drama, says Matthew Roszak, co-founder & chairman of blockchain enterprise software company Bloq.

"This entire process will be a key test for bitcoin in its evolution beyond a store of value and show its potential to grow into something much greater. Sentiment trader think keep watching this space to see how AUGUST pans out.

"This high school dropout who invested in bitcoin at $12 is now a millionaire at 18"

in the news This high school dropout who invested in bitcoin at $12 is now a millionaire at 18? What this all about..... See below..

------------------------------

erik finman
erik finman

Erik Finman made a bet with his parents that if he turned 18 and was a millionaire, they wouldn't force him to go to college. Thanks to his savvy investments in bitcoin and the current all-time high valuation, he won't have to get his degree.

"I can proudly say I made it, and I'm not going to college," Finman said.

He currently owns 403 bitcoins, which at the current $2,700 a coin puts his bitcoin value at $1.09 million. He also has smaller investments in other cryptocurrencies, including litecoin and ethereum.

Bitcoin is very volatile, and the value could decline rapidly. A technical analyst told us he believes bitcoin will only go up to $2,800 before the value recedes, while others think it may reach $100,000 in a decade.

Finman thinks its best days are still ahead. "Personally I think bitcoin is going to be worth a couple hundred thousand to a million dollars a coin," he said.

Bitcoin and the blockchain technology it is built on allow people to cut out the middleman, Finman explained. For example, an open source blockchain ride-share platform would allow users to power the service on their phones using peer-to-peer technology without a central hub. It would allow the drivers to get more money by cutting overhead costs, he added. It could also create the next evolution of the internet, one which wouldn't be reliant on servers.

The first time, he turned $1,000 into $100,000

Finman began investing in bitcoin in May 2011 at the age of 12, thanks to a $1,000 gift from his grandmother and a tip from his brother Scott.

Though he's close with his family — which he calls the "Elon Musk version of the Kardashians" — growing up in "small town" Idaho outside of Coeur d'Alene wasn't easy. Finman was especially frustrated with his high school teachers, and begged his parents to let him drop out at 15.

"(High school) was pretty low quality," he said. "I had these teachers that were all kind of negative. One teacher told me to drop out and work at McDonald's because that was all I would amount to for the rest of my life. I guess I did the dropout part."

Surprisingly, his parents — who met pursuing their Ph.D.s at Stanford — agreed. Finman sold his first bitcoin investments at the end of 2013, when they were valued at $1,200 a piece.

With the $100,000 Finman launched an online education company called Botangle in early 2014 that would allow frustrated students like him to find teachers over video chat. He also used the funds to move to Silicon Valley, did some fun things like meet Reddit co-founder Alexis Ohanian and traveled.

"I really liked Colombia," he said. "It was fun, but a little sketchy. Some interesting stuff happened. I was held up at gunpoint there, which is pretty scary, but I have this emergency button I programmed in Android that puts you on speaker but turns off audio automatically and dials [a local emergency number]."

"Maybe I'll turn that into an app," he added. "It's handy."

It was hard getting people to take a 15-year-old tech entrepreneur seriously, Finman admitted. He recalled being called in to interview with a "really, really high-up" unnamed Uber executive, who instead of listening to his Botangle pitch discouraged him and told him he would never win the bet with his parents.

Eventually he found a buyer for Botangle's technology in January 2015. The investor offered either $100,000 or 300 bitcoin, which had dropped in value at that time to a little more than $200 a coin. He took the lower cash value bitcoin deal because he believed it was "the next big thing."

"My parents asked 'Why don't you take the more cash?"' Finman explained. "But I thought of it more of an investment."

Since then, Finman has been managing his family and his own bitcoin investments. He's also kept busy on other projects, including working with NASA to launch a rocket through the ELaNa project. One thing he won't do is go back to school.

"I never got my GED, and I don't see the value in it," Finman said. "The purpose of that would be to get another education level and get a job. I had to learn through running a business. Instead of writing essays for English class, I had to write emails to important people."

Although the rest of his family has degrees — his brother Scott went to Johns Hopkins at 16 and now has an enterprise software company, while his other brother Ross went to Carnegie Melon at 16 for robotics and is now pursuing his Ph.D. at MIT — he's happy learning about the real world from experience.

"The way the education system is structured now, I wouldn't recommend it," Finman said. "It doesn't work for anyone. I would recommend the internet, which is all free. You can learn a million times more off YouTube and Wikipedia..
